Positions, headcount, skills, shifts, wages — Nhan Kiet surveys the factory on the ground and finalizes the unit price.

Cost of employment
Employing someone in Vietnam costs more than the salary itself. As of 1 January 2026, the statutory minimum wage under Decree 293/2025/NĐ-CP is 5,310,000 VND per month in Region I, and on top of gross pay the employer contributes 21.5% of the contribution base in compulsory insurance.

Worked example — part-time staff. On a contribution base of 2,530,000 VND per month, the employer pays 543,950 VND (21.5%) and the employee 265,650 VND (10.5%), for a total of 809,600 VND per person per month.
Part-time staff come under compulsory social insurance when both conditions are met: an employment contract of at least one month, and monthly wages at or above the reference level.

The manpower supply fee is settled monthly by the actual number of workers and workdays: the unit price covers the workers' wages, insurance, taxes and the service fee — all itemized on the statement for both sides to reconcile before payment, with a valid invoice issued. Yes, when the provider holds a labour sub-leasing licence. Nhan Kiet operates under licence No. 15/2019/SHCM issued by Ho Chi Minh City, first issued as No. 029/LĐTBXH in 2015. Supplying workers under this model without a licence is unlawful, and the exposure is not the provider's alone — the client is liable too.
Labour outsourcing is capped at 12 months per worker under Article 53 of the Labour Code 2019. Work that needs to run longer is normally restructured onto a service contract, which carries no time limit — under that route Nhan Kiet assigns and supervises its own crew and answers for the result you specify, rather than placing workers under your direct management.
Labour outsourcing is limited to the 20 job categories listed in Appendix II of Decree 145/2020/ND-CP, and Article 53 of the Labour Code 2019 permits it in only three situations: a sudden, time-bound spike in labour demand; temporary cover for someone on maternity, work-accident, occupational-disease or civic-duty leave; or a genuine need for high-level technical skill. Work outside those categories is handled under a service contract instead.
Yes. Liability for disguised labour outsourcing is joint in Vietnam — it falls on the client as well as the provider, with fines of up to VND 100 million for an organisation — Article 19(2) of Decree 283/2026/ND-CP, which replaces Decree 12/2022/ND-CP from 10 September 2026 — plus back-payment of wages and social contributions. This is why Nhan Kiet settles which contractual route fits your case before anything is signed.

Under Article 98 of the Labour Code 2019, overtime is paid at 150% of the normal hourly rate on ordinary days, 200% on weekly rest days and 300% on public holidays and paid leave days. Night work carries a further 30%, and overtime worked at night adds another 20% calculated on the day rate for that type of day — which is how the premium reaches 390% on a public-holiday night shift.
